Huurmarkt provides an online platform where users:

• Can list items
• Can rent items
• Can communicate with each other
• Can process payments via external providers

All agreements arise between renter and owner.

Huurmarkt is not a party to that agreement.

Renter liability#

Renters are responsible for:

• Careful use of the rented item
• Following the agreements made
• Returning on time
• Damage caused by negligence or misuse

If damage occurs during the rental period, the renter may be liable under platform policy and applicable law.

Owner liability#

Owners are responsible for:

• Lawfully listing the item
• Providing accurate and complete descriptions
• The safety and suitability of the item
• Providing correct information

Owners remain responsible for their property and its condition.

Liability for damage or injury#

Huurmarkt is not liable for:

• Damage to property
• Bodily injury
• Indirect or consequential loss
• User errors by renters
• Incorrect product information provided by owners

Users are responsible for safe use and inspection of items.

Liability for vehicles#

For car rentals or other vehicles:

• The renter is responsible for compliance with traffic rules.
• The renter is responsible for fines and violations.
• The owner remains responsible for the vehicle registration.
• Huurmarkt is not a party to traffic incidents.

Further handling runs between the parties involved themselves, and via their own insurers if they have any. Huurmarkt is not a party to that and does not provide insurance itself.

External services#

Huurmarkt uses external partners for:

• Payment processing
• Identity verification

Huurmarkt is not liable for:

• Outages at external providers
• Decisions made by payment providers

Limitation of liability#

To the extent permitted by law, Huurmarkt's liability is limited to:

• The amount Huurmarkt has received for the transaction in question

Huurmarkt is not liable for indirect or consequential loss.

Force majeure#

Huurmarkt is not liable for failures resulting from force majeure, including:

• Technical outages
• Network problems
• Government measures
• External system failures
• Natural disasters

Indemnification#

Users indemnify Huurmarkt from:

• Claims between renter and owner
• Damage arising from use of the platform
• Violations of laws or regulations by users
